Can you fail roadside drug testing from passive smoking of cannabis?

According to a driver in Queensland you can. As reported in a Courier Mail article, he told police that he returned a positive roadside drug test because he had been at a his grandfather’s wake the previous night, where there had been “smoking going on”.

The driver, Tony Woodrow, appeared before Maryborough Magistrates Court earlier this week where he pleaded guilty to one charge of drug driving. According to the article, he pleaded guilty because he accepted he did have the drug in his system. He was fined $200 and disqualified from driving for one month.

Mr Woodrow said in the future he would be more careful when around other who were smoking.
